What you need to know about LPAs
A Lasting Power of Attorney (LPA) is a document that grants permission for an appointee – known as an attorney – to take care of you and make decisions on your behalf if you lose capacity through illness or injury.
You can make a Lasting Power of Attorney at any time, although it is best to get one written you while you are young, fit and healthy. It doesn’t need to come into effect straightaway, but you can ask for your attorney to begin handling your affairs from the date the LPA is registered, if you feel you need extra support.
You need to think carefully about who you choose to name in the document, because, depending on the type of agreement you choose to draw up, your attorney may have the power to:
-
Open, close and manage your accounts with banks and building societies
-
Access your welfare benefits or tax credits
-
Manage your tax affairs
-
Manage your debts
-
Sell your property
-
Decide where you live
-
Choose when and where you receive medical treatment
-
Take charge of your day-to-day care
You can create Powers of Attorney to cover matters relating to your Property and Financial Affairs or your Health and Welfare (or both).
